MOTION FOR APPLICATION BY LAWFUL OWNER FOR RESTITUTION OF PROPERTY
(article 490 du Code Criminelle)
TO ONE OF THE HONORABLE JUDGES OF THE COURT OF QUEBEC, CHAMBRE
CRIMINELLE ET PENALE, IN THE DISTRICT OF LAVAL, THE APPLICANT
PRESENTS THE FOLLOWING:
1.The Defendant Danny Hunt residential address of, 1870 Robinson apt.301, Laval
(Québec) H7T 1L6, District of Laval;
2.The lawful owner Danny Hunt requests restitution of his property, one desktop
computer, one laptop computer, one hard disk holder, two hard disks, and any other
hardware taken without warrant on February 21, 2011 by the Laval Police dept;
3.The allegations in the event LVL-110221-041 and court file 540-01-048499-118 are
said to have occurred on facebook hosted by servers, therefor no evidence to support
the allegations in this event resides on these computers or the computers of individuals;
4.The computers taken from Danny Hunt help him break his isolation, manage his
finances, and are also required for the research he does on psychological harassment
for the world leading website called Psychological Harassment Information Association
as stated in his letter to his elected member of Parliament Guy Oullette; P-1
5.The Intime Demandeur is represented by Me Jonathan Boivin, Procureur de l'intimée (Ville de
Laval), Palais de Justice Laval, 2800, boulevard Saint-Martin Ouest, Laval (Québec), H7T 2S9;
6.This motion is well founded in facts and law.
FOR THESE MOTIVES, MAY IT PLEASE THE COURT:
RECEIVE the present motion;
GRANT restitution of property to the lawful owner Danny Hunt, the defendant;
RENDER judgement in accordance to the demands of justice;
THE WHOLE without costs.
